Terms of Service
Effective Date: 1/1/26
Last Updated: 8/3/26
1. Agreement and Acceptance
These Terms of Service (“Terms”) are a binding agreement between you and Youth Sports Clarity (“YSC,” “we,” “us,” or “our”). By accessing or using the Services, creating an account, clicking an acceptance box, or purchasing a product or subscription, you agree to these Terms and acknowledge the Privacy Policy and General Disclaimer below. If you do not agree, do not use the Services.
If you use the Services for an organization or another person, you represent that you have authority to bind that organization or person, and “you” includes them. You may not use the Services if applicable law prohibits you from doing so.
2. Who We Are and What We Provide
Youth Sports Clarity provides educational content, parent advocacy and organization tools, documentation resources, communication templates, courses, digital products, private record tools, and AI-assisted drafting features related to youth sports communication, decision-making, and family support.
Important limitation. YSC is not a law firm, medical provider, mental health provider, emergency service, crisis service, investigative body, child-protection agency, mandated-reporting service, SafeSport reporting channel, school, club, league, national governing body, or government agency.
3. Eligibility and Adult Use
The Services are intended for adults. You must be at least 18 years old and legally capable of entering a contract to create an account, purchase a product, start a subscription, upload content, or use an interactive tool. A parent or legal guardian may share appropriate educational content with a minor under direct adult supervision, but minors may not independently create accounts, make purchases, upload files, or submit personal information.
Do not misrepresent your age or identity. We may request reasonable information to verify eligibility, authority, or account ownership.
4. Accounts and Security
You must provide accurate, current information and keep it updated. You are responsible for safeguarding your credentials and for activity under your account, except to the extent caused by our failure to use reasonable security measures. Do not share credentials or permit unauthorized access. Notify us promptly at support@youthsportsclarity.com if you suspect unauthorized access.
We may require email confirmation, password resets, multifactor authentication, or other safeguards. We may refuse registration, reclaim usernames, or suspend access when reasonably necessary to protect users, minors, the Services, or third parties.
5. License and Permitted Use
Subject to these Terms and payment of applicable fees, YSC grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services and purchased materials for your own non-commercial family use. No ownership rights are transferred.
You may download, print, edit, and use templates or generated outputs for your personal youth sports matters. You may share a completed communication or report with relevant recipients for that matter. You may not distribute blank templates, course materials, libraries, or substantial portions of the Services to others.
6. Prohibited Conduct
You may not, and may not help anyone else to:
- use the Services for unlawful, fraudulent, abusive, threatening, harassing, discriminatory, exploitative, or deceptive activity;
- submit knowingly false accusations, impersonate another person, fabricate evidence, or use generated content to defame, intimidate, retaliate against, or target anyone;
- upload sexual content involving a minor, content that exploits a minor, malware, unlawfully obtained material, or content you have no right to provide;
- use the Services as a substitute for emergency reporting, mandated reporting, professional advice, or an official complaint or safety channel;
- scrape, crawl, harvest, frame, mirror, copy, resell, sublicense, publish, redistribute, or commercially exploit the Services or YSC materials except as expressly permitted;
- reverse engineer, decompile, probe, bypass, interfere with, overload, or defeat access controls, security, rate limits, or technical restrictions, except where applicable law expressly permits it;
- use YSC content or private service output to train, fine-tune, benchmark, or build an AI or machine-learning system without written permission;
- access another user’s account or content, share an account, or test vulnerabilities without written authorization; or
- remove ownership notices or falsely imply endorsement, affiliation, accreditation, or official status.
7. User Content and Your Responsibilities
“User Content” means information or material you submit, upload, save, type, record, or generate through the Services, including notes, incident descriptions, names, dates, screenshots, photos, emails, files, reports, and draft communications. As between you and YSC, you retain ownership of your User Content.
You grant YSC and its service providers a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, format, process, and otherwise use User Content only as reasonably necessary to provide, secure, maintain, troubleshoot, improve, and support the Services; follow your instructions; enforce these Terms; or comply with law. This license ends when the content is deleted from active systems, subject to reasonable backup, security, fraud-prevention, and legal-retention periods.
You represent and warrant that you have all rights and lawful authority needed to submit User Content and grant this license. You are solely responsible for its accuracy, legality, relevance, and appropriate disclosure. Use initials or roles where practical and avoid unnecessary information about children or third parties.
8. Sensitive Situations and Safety
Not monitored for emergencies. YSC does not continuously monitor submissions and does not promise to detect, review, report, escalate, or respond to dangerous or unlawful content. Entering information into a Service does not notify any outside person or authority.
If you believe anyone faces immediate danger, call 911 or the appropriate local emergency service. For suspected child abuse, sexual misconduct, grooming, serious threats, self-harm, violence, or other urgent safety concerns, contact the appropriate law-enforcement, child-protection, medical, school, league, governing-body, or SafeSport channel directly. Your legal reporting duties and deadlines remain your responsibility.
9. AI-Assisted and Automated Features
Some Services use artificial intelligence, templates, or rules-based automation to organize information or draft text. Outputs are generated from patterns and instructions and may be inaccurate, incomplete, outdated, biased, overly strong, overly soft, legally inappropriate, emotionally inappropriate, or unsuitable for your facts or intended recipient.
You must independently review, edit, verify, and approve every output before using or sending it. Do not rely on an output as a finding of fact, evidence, professional judgment, legal conclusion, safety assessment, or prediction of an outcome. You are responsible for decisions and communications made using an output.
10. Intellectual Property
The Services and all YSC-provided content, software, interfaces, workflows, designs, text, graphics, logos, names, audio, video, courses, templates, downloads, compilations, and other materials are owned by YSC or its licensors and are protected by intellectual-property and other laws. Youth Sports Clarity, Parent Clarity, and associated branding may not be used without written permission.
Feedback you voluntarily provide may be used by YSC without restriction or compensation, provided we do not publicly identify you without permission. Feedback does not include your private User Content.
11. Third-Party Services, Links, and App Stores
The Services may rely on or link to third-party providers, including hosting, authentication, storage, payment, analytics, email, support, and AI providers. Third-party services are governed by their own terms and privacy practices. YSC does not control and is not responsible for third-party content, decisions, availability, security, or performance, except as required by law.
If you obtain a mobile application through Apple’s App Store, Google Play, or another marketplace, the marketplace’s applicable terms also apply. The marketplace is not responsible for YSC’s Services, support, warranties, claims, or content except to the extent its standard terms say otherwise. Purchases, cancellations, and refunds processed by a marketplace may need to be managed through that marketplace.
12. Purchases, Billing, Taxes, and Authorization
Prices and included features are shown at checkout and may change prospectively. You authorize YSC and its payment processors to charge the payment method you provide for disclosed prices, recurring fees, taxes, and other agreed charges. You must provide accurate billing information and are responsible for applicable taxes, excluding taxes on YSC’s income.
A payment processor or app store may apply separate terms. YSC does not intentionally receive or store complete payment-card numbers when payment is handled by a third-party processor.
13. Subscription Renewal and Cancellation
If you purchase a subscription, it automatically renews for the renewal period and at the price disclosed at checkout unless you cancel before the renewal date. Before purchase, the checkout should disclose the recurring price, billing frequency, trial terms (if any), cancellation method, and material restrictions. Promotional or introductory pricing may change to the disclosed standard price after the promotion ends.
You may cancel through the account or billing portal identified in the Service or by contacting support@youthsportsclarity.com. Cancellation stops future renewal charges but ordinarily does not end access before the close of the already-paid billing period. Deleting an app does not cancel a subscription. Subscriptions purchased through an app store must generally be canceled through that store.
We may change subscription prices or material features prospectively after providing notice required by law. If payment fails, we may retry the charge, request updated information, downgrade access, or suspend the subscription.
14. Refund Policy
Except where required by law or expressly stated at checkout, purchases of digital downloads, templates, courses, and other immediately accessible digital content are final after access or download. Subscription fees and prior renewal charges are non-refundable after the billing period begins, and we do not provide prorated refunds for unused time, account inactivity, or failure to cancel before renewal.
If a product is materially defective, inaccessible because of a verified technical issue, or purchased in error, contact support@youthsportsclarity.com within seven days of purchase. We may, in our discretion, repair access, replace the product, issue a credit, or provide a refund. This does not limit any non-waivable consumer right. Marketplace purchases are subject to the marketplace’s refund process and rules.
15. Availability, Changes, and Beta Features
We may add, modify, restrict, suspend, or discontinue features, content, integrations, storage limits, or Services at any time. We do not guarantee uninterrupted, secure, error-free, or permanent availability. We may impose reasonable usage, file, storage, or rate limits.
Preview, beta, experimental, or free features may be changed or withdrawn without notice and may contain errors. Back up important records and exports. The Services are not an archival, evidence-preservation, or records-management system.
16. Moderation, Suspension, and Termination
We may investigate suspected misuse and remove content or suspend, limit, or terminate access when we reasonably believe it is necessary to enforce these Terms, prevent harm, address security or legal risk, respond to nonpayment, or protect YSC, users, minors, or third parties. Where practical and legally permitted, we may provide notice and an opportunity to cure.
You may stop using the Services at any time and may request account deletion as described in the Privacy Policy. Termination does not automatically cancel a separately billed subscription unless the applicable billing flow confirms cancellation. Provisions that by their nature should survive will survive, including ownership, payment obligations, disclaimers, limits of liability, indemnity, dispute terms, and accrued rights.
17. Copyright and Rights Complaints
If you believe content in the Services infringes your copyright or other rights, send a detailed notice to support@youthsportsclarity.com identifying the work or right, the allegedly infringing material and its location, your contact information, a good-faith statement, a statement that the information is accurate and that you are authorized to act, and your physical or electronic signature. We may remove material and, when appropriate, terminate repeat infringers.
18. No Professional or Fiduciary Relationship
Use of the Services does not create an attorney-client, doctor-patient, therapist-client, counselor-client, fiduciary, advocate-client, investigator, confidential-source, or other professional relationship. Communications with YSC are not privileged. Support personnel do not represent you before any organization or authority.
19. Disclaimers of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT, OUTPUTS, PRODUCTS, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. YSC AND ITS OWNERS, AFFILIATES, LICENSORS, VENDORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, QUIET ENJOYMENT, SECURITY, AVAILABILITY, AND RESULTS.
YSC DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR COMPATIBLE; THAT DATA WILL NEVER BE LOST OR EXPOSED; THAT DEFECTS WILL BE CORRECTED; OR THAT ANY OUTPUT, COMMUNICATION, REPORT, ESCALATION, OR DECISION WILL BE APPROPRIATE, ACCEPTED, EFFECTIVE, ADMISSIBLE, OR SUCCESSFUL. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YSC AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, LICENSORS, VENDORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, PLAYING TIME, TEAM PLACEMENT, OR REPUTATION; EMOTIONAL DISTRESS; PERSONAL OR FAMILY CONFLICT; OR COSTS OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF YSC AND THOSE PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID DIRECTLY TO YSC FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT FIRST GIVING RISE TO LIABILITY.
These limitations do not exclude liability that cannot lawfully be excluded or limited, and they apply regardless of the legal theory and even if a remedy fails of its essential purpose.
21. Indemnification
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless YSC and its owners, affiliates, employees, contractors, licensors, vendors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs and attorneys’ fees arising from your User Content; unlawful or unauthorized use; breach of these Terms; violation of another person’s rights; or messages, reports, allegations, or other materials you send or publish using the Services. YSC may control the defense and settlement of a covered claim, and you will reasonably cooperate. You may not settle a claim in a way that admits fault by or imposes obligations on YSC without written consent.
22. Informal Dispute Process
Before filing a lawsuit (other than an urgent request for temporary injunctive relief or a qualifying small-claims matter), the complaining party must send a written notice describing the dispute, relevant facts, requested relief, and contact information. Notices to YSC must be sent by email to support@youthsportsclarity.com and by mail to the address below. The parties will attempt in good faith to resolve the matter for 30 days after receipt. Any limitations period is tolled during that 30-day period where permitted by law.
23. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Subject to any non-waivable consumer right, any court proceeding must be brought exclusively in the state or federal courts located in Orange County, California, and each party consents to their personal jurisdiction. Either party may bring an eligible individual matter in small-claims court.
24. Changes to These Terms
We may update these Terms prospectively. We will post the revised version and update the “Last updated” date. If a change is material, we will provide additional notice where required, such as by email, in-app notice, or a prominent website notice. Changes take effect on the stated effective date. Your continued use after that date constitutes acceptance to the extent permitted by law. Material changes will not retroactively reduce accrued rights without your consent where consent is required.
25. General Terms
These Terms, together with the Privacy Policy, General Disclaimer, and any specific checkout or product terms, are the entire agreement about the Services. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; YSC may assign them in connection with a merger, reorganization, sale of assets, or by operation of law. No third party is a beneficiary except as expressly stated. Section headings are for convenience. Electronic communications and signatures satisfy writing requirements to the extent permitted by law.
